CONTRACT CONCLUSION

Negotiation of essential terms of the contract takes place via email and these terms apply to the contract.

The contract is considered concluded upon receipt of the first instalment by the publisher and the parties do not need to sign the contract.
The terms of the contract have been made available to the customer during negotiations, on the publisher's website, and will also be presented to the customer with the first instalment invoice.
14-DAY CANCELLATION POLICY
We offer a 14-day cancellation window, in accordance with consumer protection standards. You may cancel your purchase within 14 days of placing your order for a full refund, provided that no custom work has begun, such as interviews, research, or writing.
Once any part of the custom writing process has started, your order becomes non-refundable. However, we are committed to your satisfaction and will work with you through revisions and collaboration to make sure you are happy with the final result.

BOOK CREATION

The customer and publisher agree on the time of delivery of the book via email. The interviewer arranges interview times with the portrait subject. The parties make changes to deadlines by agreement, with the goal of ensuring a quality result and the satisfaction of the customer and portrait subject, taking into account reasonable circumstances arising from the cooperation between the interviewer, writer, and portrait subject.

The interviewer conducts interviews with the portrait subject at a location suitable for the portrait subject within the UK or, in extreme necessity, via video. Interviews are recorded.

The total time allocated for interviews within the service is six hours, which will be divided into different meetings by agreement between the interviewer and the portrait subject. If desired, additional interview hours can be arranged, resulting in a longer and more detailed book. In such cases, the customer and publisher agree on additional compensation.

The writer creates the book manuscript based on the interviews, preserving the portrait subject's personality and narrative style, and connecting the portrait subject's story into a logical whole.

During the interview and book writing process, the customer or portrait subject can provide digitised photos or paper photos for inclusion in the book, the digitisation of which is arranged by the publisher without additional charges.

During the book writing period, the customer and portrait subject have the right to review the book manuscript and make suggestions for changing, correcting, and supplementing the text. After feedback is submitted, planned changes are agreed upon, after which the writer continues writing the book.

When the manuscript is sent to the customer or portrait subject for review, the customer or portrait subject has two weeks to make suggestions regarding the manuscript and confirm the final version. If no suggestions are made within two weeks, the publisher considers the manuscript confirmed and the book will be printed based on it. If the customer wishes to make changes after printing, this can be done for an additional fee.
COPYRIGHT FOR THE BOOK

The copyright for the book manuscript and print file belongs to the publisher. The publisher grants the customer a non-exclusive licence for the property rights to use the book manuscript and print file within family and social circles.

The customer has the right to use the manuscript copyright during the licence term, including publishing the text, translating it, making changes to the text, and adding new parts to the text. The use of the book print file to create a new publication is subject to the publisher's consent, meaning that if the customer wishes to make a repeat order of the book, the order must be made according to the publisher's price list.

The publisher confirms that it owns the copyright for concluding the contract and granting the licence, and that the conclusion of the contract does not violate any person's copyright.
BOOK PHOTOS

The publisher assumes that the photo copyrights belong to the customer or portrait subject or fair use is permitted (for personal use purposes). If the reproduction of photos is based on copyright, the customer or portrait subject grants the publisher a non-exclusive licence to exercise the property rights of the photos for the purpose of creating and printing the book print file. The licence is valid as long as the print file is in the publisher's possession, but not less than 25 years.

Under the non-exclusive licence, the publisher has the right to reproduce photos by any technical means, process photos partially or completely by technical means, compile collections, and exercise other rights necessary for compiling a print file containing photos and printing the book.

The publisher will return all photos received from the customer on physical media to the customer or portrait subject no later than the end of the contract.
PROCESSING OF PERSONAL DATA

The customer confirms that the publisher may process the portrait subject's personal data for the creation of the book.

The publisher has the right to use the portrait subject's name, image, and any biographical data that the portrait subject has disclosed for the creation of the book. The publisher uses the portrait subject's personal data only for compiling the book.

The portrait subject discloses personal data during interviews on the basis of which the book is created. If the portrait subject does not wish to reflect certain private life events in the book, they must explicitly inform the interviewer or publisher.

The publisher, writer, and interviewer undertake to keep confidential the information that the portrait subject discloses during interviews and book creation, including information contained in the book. For the purpose of protecting personal data and privacy, the publisher, writer, and interviewer will not disclose such information to third parties without the prior written consent of the portrait subject. The book is not intended for public distribution (e.g., sale in bookshops).

The publisher, writer, and interviewer are not responsible for incorrect factual claims and inappropriate value judgments presented by the portrait subject. Once the book is handed over to the customer, the publisher or portrait subject as the publisher is responsible for incorrect factual claims and inappropriate value judgments contained in the book.
PAYMENT

The customer pays the publisher a fee for fulfilling the obligations arising from the contract either as a one-time payment or in instalments according to a payment schedule.

The publisher and customer agree on the amount of the fee payable for the service and the payment schedule based on the publisher's offer. The service fee includes a fee for one printed copy of the book.

The fee includes VAT according to the VAT rate applicable in the United Kingdom.

The customer has the opportunity to order additional copies during the service provision or after the completion of the book according to the publisher's price list. Prices may vary depending on the size of the print run ordered at one time. Transport of additional copies of the book to the customer is at the customer's expense, unless otherwise agreed.
VALIDITY OF THE CONTRACT

The contract between the customer and the publisher enters into force upon receipt of the first payment by the publisher.

The contract is valid until the publisher has handed over the book to the customer. Copyright and confidentiality agreements remain in force for the period specified in these terms.

The customer can withdraw from the contract only in case of a material breach of contract by the publisher. If the portrait subject abandons interviews and cooperation, this is not considered a withdrawal from the contract. In such a case, the customer and publisher seek a joint solution on how to continue fulfilling the order. If the parties agree to terminate the contract, the customer must pay the publisher proportionally for the work done.
FINAL PROVISIONS

The contract is governed by the law of the United Kingdom. The parties undertake to implement all appropriate measures to resolve all disputes arising from the contract through negotiations. If the publisher has refused to satisfy the customer's complaint or the customer does not agree with the solution offered by the publisher and believes that their rights have been violated or their interests have been damaged, the customer may file a complaint with the appropriate County Court.
